Consistent with our desire to help guide Connecticut residents through national crises, SGT is seeking to help Connecticut clean up PFAS contaminations across the state. These efforts build on SGT's efforts representing a group of residents from Westminster, Massachusetts, in the class action lawsuit Ryan v. The Newark Group, where SGT represents families impacted by the contamination of the water supplies and topsoil of hundreds of homes with PFAS due to activities at a composting facility named Massachusetts Natural Fertilizer Company. The contamination was discovered in February 2022, when a resident tested his private well water and found alarmingly high levels of PFAS, marking one of the most severe PFAS contamination cases in Massachusetts history. Over 300 homes have been impacted, with residents unable to use their well water for drinking, cooking, or gardening​.

The Ryan plaintiffs are seeking comprehensive remediation of the contaminated land, compensation for dimunition of property values, and establishment of a medical monitoring program. Remediation efforts aim to restore safe water and soil conditions, while the medical monitoring program is intended to provide ongoing health assessments for affected residents to detect and address any PFAS-related health issues early. The lawsuit includes claims for negligence, public and private nuisance, and depreciation of property values, reflecting the broad impact of the contamination on the community's health and well-being​.

In a landmark decision, the court allowed the plaintiffs' Racketeer Influenced and Corrupt Organizations Act (RICO) claims to proceed, marking the first application of the federal RICO statute against alleged environmental polluters. This decision underscores the severity of the allegations and the potential for significant legal repercussions for the defendants. By pursuing this litigation, Silver Golub & Teitell LLP aims to secure justice for the residents of Westminster and drive meaningful environmental and regulatory changes to prevent future contamination.
